Trademark FAQs - related questions & answers

Question: When is it proper to use the federal registration symbol?

Answer:
The federal registration symbol may be used once the mark is actually registered in the U.S. Patent and Trademark Office. Even though an application is pending.

Question: How are characters like a hypen treated in a tradmark?

Answer:
The pronunciation of the trademark is the most controlling factor. So whether or not similar marks have dashes separating elements of one or the other mark wouldn't make much difference in deciding.

Question: How long is a trademark or service mark registration active?

Answer:
The registration is active for ten years. At the end of ten years, the mark may be renewed for another ten years. The mark may be renewed every ten years as long as the mark is in continual use.
